WARRANTY:
1. Limited Warranty. Harvest
Timber Co. warrants to the original purchaser of prefinished
Pioneered Wood flooring that ninety percent (90%) of the factory-applied
coating, under normal residential conditions, will not wear
through to the wood or separate from the wood for fifteen years
from the date of installation. If ten-percent (10%) or more
of the finish wears through or separates from the wood, Harvest
Timber Co. agrees to refinish or repair the floor. Customer’s
right to have the coating replaced or repaired is the sole and
exclusive responsibility of the customer upon breach of this
limited warranty. This limited warranty is not transferable.
Wood
is a product of nature and naturally occurring variations and
characteristics such as grain, color, mineral streaks and knots
are not breaches of Harvest Timber Co.’s limited warranty. Flooring
is susceptible to fading and color change due to the sun’s
ultraviolet rays. Sun fade, color change, scratches, gouges,
indentations, misuse, damage caused by lack of proper care,
insufficient protection under furniture, other abrasives, spiked
heel shoes, pets, insects, and damage due to water or moisture
are not covered by Harvest Timber Co.’s limited warranty.
2.
Negation of Implied Warranties. Except
as provided in section 1 above, there are no express or implied
warranties including, but not limited to, any warranty of merchantability
or fitness for particular purpose or correct installation.
3.
Installation.
Harvest Timber Co. makes no warranties regarding installation
of any flooring product. It is the responsibility of the installer
or homeowner to inspect boards prior to installation. Flooring
pieces that are obviously damaged or otherwise unsuitable should
not be installed. Industry standards allow for up to ten percent
(10%) for defective boards that must be cut but cannot be used
for the job or installation. No installer, retailer or agent
has the authority to alter the obligations or limitations of
this limited warranty.
4.
Limitation of Damages. In
no event shall Harvest Timber Co. be liable to customer or
to any other person for any indirect, special, incidental or
consequential damages arising out of or related to the performance
of products produced by Harvest Timber Co. or the breach hereof,
even if Harvest Timber Co. has been advised of the possibility
thereof, including but not limited to, damages resulting from
or related to any failure of the product involved or the coating
applied to the product.
5.
Warranty Disclaimers and Exclusions. Variations
in flooring are a natural occurrence, therefore flooring may
not match display samples or other wood products such as cabinets,
trim and mouldings. Gloss reduction is not considered surface
wear. Damage from water and/or moisture from any source or
condition is excluded from warranty coverage. Variations in
wood grain, color, streaks and knots are not considered defects.
Normal exposure to sunlight will change coloring in wood floors.
Area rugs should be moved occasionally as they block sunlight
and may create a “shadow” effect on the flooring; this is not
a product defect. Installation must be performed in accordance
with National Wood Flooring Association (NWFA) instructions.
